These Terms constitute a legally binding agreement between you and Drivyn, governing your access to and use of www.drivyn.in and the purchase of products offered thereon.

By accessing the website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must refrain from using the website or placing orders.
Section 01
Drivyn is a premium car culture art brand offering limited edition art prints under the Monolith I collection and subsequent releases. The brand is operated as an independent entity based in India. All transactions conducted through www.drivyn.in are governed by the laws of India.

By placing an order on www.drivyn.in or accessing the website, you represent and warrant that:

Drivyn offers premium art prints produced on museum-grade fine art paper or equivalent archival media. Product descriptions, dimensions, and finishes are set out on the respective product pages. All product imagery is provided for illustrative purposes and may vary slightly from the physical print due to screen calibration differences.
Products are subject to availability. Drivyn reserves the right to discontinue, limit, or withdraw any product from the storefront at any time without prior notice. In the event that a product becomes unavailable after your order has been placed and confirmed, Drivyn will notify you and issue a full refund.
All prints sold by Drivyn are works of original art created under the Drivyn brand. They are intended for personal, non-commercial display purposes only. No reproduction, distribution, or commercial use of the artwork is permitted without express written consent from Drivyn.
Section 04
Prices for domestic (India) orders are displayed and charged in Indian Rupees (INR). Prices for international orders are displayed in United States Dollars (USD) or the applicable local equivalent as supported by our payment infrastructure. Currency conversion rates are indicative and subject to fluctuation.
Drivyn reserves the right to modify pricing at any time. Price changes will not apply to orders that have already been confirmed. Confirmed orders will be fulfilled at the price displayed at the time of checkout.
All prices displayed on www.drivyn.in are inclusive of applicable Indian Goods and Services Tax (GST) where required. For international orders, customers are responsible for any applicable import duties, taxes, and customs fees as outlined in the Shipping Policy.
Section 05
An order is placed when you complete the checkout process and receive an order confirmation email. This confirmation constitutes an acknowledgment of receipt and does not, by itself, constitute acceptance of the order. Drivyn reserves the right to cancel any order at its sole discretion, in which case a full refund will be issued.
Drivyn accepts payments via Razorpay (for domestic INR transactions) and PayPal (for international transactions). All payments are processed through secure, encrypted payment gateways. Drivyn does not store card or payment credential information.
If payment is not successfully captured, the order will not be processed. Drivyn will not reserve stock or commence production for unpaid orders.
A valid order confirmation email constitutes proof of purchase. Customers are advised to retain this email for their records.
Section 06
Order cancellation is not permitted once placed, as production and processing commence immediately upon order confirmation. To raise a cancellation query, write to drivynofficial@gmail.com with the subject line "Order Cancellation / Order Issue" and include your order number.
Once an order has entered the production or dispatch phase, it cannot be cancelled. Drivyn does not accept cancellations on the basis of change of mind after an order has been placed.
Section 07
Given the bespoke, made-to-order nature of Drivyn art prints, returns are not accepted on the basis of change of mind, preference, intentional damages, or personal dissatisfaction with the artwork's aesthetic.
In the event that you receive a defective print or an incorrect item, Drivyn will arrange a replacement. Claims must be submitted within two (2) hours of delivery to drivynofficial@gmail.com with photographic evidence and genuine video evidence. Claims raised after this window will not be accepted.
Refunds are issued only in the following circumstances: the product is confirmed defective and a replacement cannot be arranged within a reasonable timeframe; or the product is unavailable after order confirmation.
Refunds will be processed to the original payment method within seven (7) to ten (10) business days. Processing timelines may vary by payment provider.
Section 08
All content on www.drivyn.in, including but not limited to artwork, design elements, typography, photography, copy, brand identity, and the Drivyn name and logo, is the exclusive intellectual property of Drivyn and is protected under applicable copyright, trademark, and intellectual property laws.
No content from the Drivyn website or products may be copied, reproduced, distributed, displayed, published, or used for commercial purposes without prior written authorisation from Drivyn. Purchasers of Drivyn prints receive a personal licence for private, non-commercial display of the physical print only. No digital rights are transferred.
Unauthorised use of Drivyn's intellectual property may give rise to civil and criminal liability.
Section 09
Drivyn operates a referral-based affiliate programme. Participation is subject to application and approval at Drivyn's sole discretion. Approved affiliates receive a unique referral link and are eligible for commission on qualifying purchases made through that link.
Commission rates, payment schedules, and qualifying criteria are set by Drivyn and may be modified at any time. Affiliates will be notified of material changes to commission terms. Commissions are not payable on fraudulent, self-referred, or reversed transactions.
Affiliates must promote Drivyn in a manner consistent with the brand's identity and values. Drivyn reserves the right to terminate any affiliate's participation immediately and without compensation if the affiliate engages in misleading, deceptive, or brand-damaging promotional activity.
Section 10
Certain features of the Drivyn website, including order history and the affiliate dashboard, may require account registration. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account.
Drivyn reserves the right to suspend or terminate accounts that are used in violation of these Terms, without prior notice.
Section 11
To the fullest extent permitted by applicable law, Drivyn shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the website, your purchase of products, or your reliance on any content on the website.
Drivyn's total aggregate liability to any customer, whether arising in contract, tort, or otherwise, shall not exceed the total amount paid by that customer for the specific order giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be lawfully excluded under Indian law.
Section 12
The Drivyn website and its contents are provided on an "as is" and "as available" basis. While Drivyn makes reasonable efforts to ensure accuracy, we do not warrant that the website will be uninterrupted, error-free, or free from technical defects. Drivyn does not guarantee that the website or its servers are free from viruses or other harmful components.
Section 13
Drivyn's website integrates with third-party service providers including Razorpay, PayPal, Brevo, Qikink, Cloudflare, and Firebase. Drivyn is not responsible for the practices, policies, or performance of these third parties. Use of third-party services is subject to their respective terms of service and privacy policies.
The Drivyn website may include links to external websites. These links are provided for informational purposes only. Drivyn does not endorse the content of external sites and is not responsible for their content or practices.
Section 14
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Maharashtra, India.
Drivyn encourages customers to resolve disputes amicably by writing to drivynofficial@gmail.com before initiating formal proceedings.
Section 15
Drivyn reserves the right to revise these Terms at any time. Revised Terms will be effective from the date of publication on the website. Your continued use of the website following the publication of amended Terms constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically.
Section 16
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.
Section 17
These Terms, together with the Shipping Policy, Privacy Policy, and any other policies published on www.drivyn.in, constitute the entire agreement between you and Drivyn with respect to your use of the website and purchase of products, superseding all prior agreements or understandings.
